M. Masinda called the Special Meeting to order at 7:30
ZBA2010-9 Application for 40’ rear yard variance to build 2nd story addition on existing foot print at 24 Balazs Road (Map 44 Lot 15 Zone R80) Owner/Applicant: James F Poirier (Received January 13, 2011 Public Hearing February 10, 2011 continued to March 10, 2011 Decision within 65 days after close of P.H.)
Public Hearing was closed on March 10, 2011
Brian Semprebon recused himself from this application.
Annemarie Poole made a motion to approve the application for a 40’ rear yard variance to build a second story addition on existing footprint.
Jerry Lopes stated that after listening to the recording of the meeting he had some question.
The Board Members discussed the location of the deck and stairs, and that the stairs were located in the common area. Jack Rup explained that in this subdivision the Associations By-Laws allow the owners to build into the common area. The building itself is inside the property lines.
Reference was made to Plot Plan prepared for James Poirier 24 Balazs Road Willington, Connecticut Sacle:1” = 3-‘ march 7, 2011 Job Number 211006 Datum Engineer & Surveying, LLC 132 Conantville Road – Mansfield Center, Connecticut 06250
Annemarie Poole stated that a 40’ rear yard variance would not be enough. M. Masinda stated that they would have to amend the application to request a 41’ rear yard variance.
Annemarie Poole motioned to approve a 41’ rear yard variance to build a second story addition on the existing footprint. William Bland seconded the motion. All voted in favor.
